Four German Higher Regional Courts (Dresden, Naumburg, Munich, Jena) ruled Meta Pixel illegal under Article 26 GDPR between November 2025 and April 2026, awarding €1,500–€3,000 per plaintiff with approximately 10,000 lawsuits pending. The Dresden court held WooCommerce stores embedding Meta Pixel are joint controllers with Meta, making them independently liable under Article 82. Hashing PII does not mitigate liability because Meta uses identical hashing internally. The architectural fix is documented processing control through first-party server-side tracking that gives the operator authority over what data leaves the store.
